ENROLLMENT AGREEMENT

This offer is for a limited time only and is on a first-come-first-served basis (based on who returns this agreement signed and pays the non-refundable security deposit first). This Agreement is not valid until/unless signed by the Owner, Director, or Assistant Director at Top Hat Montessori, as space is limited.

Please read this Agreement carefully. If you do not understand any part of this Agreement, feel free to ask the Director about it. This Agreement establishes your legal rights and responsibilities, and those of the school, regarding your child’s participation in the School. Throughout this Agreement, the terms “you” and “parent” refer to the parent(s) or legal guardian(s) of the child enrolled in the School, and the terms “School” and “we” refer to Top Hat Montessori and its staff members. The term “school day” means a day when the School is open and operating. The term “child” means all children enrolled by the parent at the School.

You, (parent(s) or guardian(s)), agree to enroll your child, (name of child), in Top Hat Montessori, and the School agrees to accept your child’s enrollment, under the following terms and conditions.

Absences

  1. Please notify the School by 7:00 a.m. if your child(ren) will be absent on a specific day.
  2. Please notify the School, a week in advance if possible, when your child(ren) will be absent due to vacation or other planned absences.

To maintain consistency in our school, tuition is charged on a per-month basis and tuition is not subject to being prorated for any reason (other than for the first month you enroll, if your child starts after the first day of the month). Accordingly, tuition will not be prorated for any other reason such as absences, illnesses, holidays, emergency or weather-related closings, vacations, or early termination/withdrawal. Tuition is charged on a per-month basis, and you will not owe any less if your child is absent for any reason, withdraws early, or whose last day is not the last day of the month. No verbal agreement may replace this term regarding prorating, and your initials to the right here indicate your understanding and agreement of this term. If you dis-enroll your child for any period of time, your child will be re-enrolled only if there is space is available at the time you want to return, and there will be a $250 re-enrollment fee.

Payment

All payments will be due by the first of each month for that month. --We do not accept cash.

  1. If any payment is returned unpaid, you will owe a service charge of $50 in addition to other amounts due.
  2. Payment is due by the first day of each month for all children, regardless of the date of initial enrollment and payment. A $50 late fee will be assessed if payment is not received by the first of the month. An additional late fee of $50 will be applied each calendar week until payment is received.

Suspension and Termination for Late Payment

  1. If the School has not received full payment by the 15th calendar day after payment is due, the School may refuse to admit your child to the School until you pay the amount due.
  2. If the School has not received full payment by the 30th calendar day after payment is due, your child’s enrollment in the School may be terminated. At the discretion of the School, enrollment may be reinstated with full payment of all outstanding amounts.

Adjustment and Trial Period

Your child is accepted for enrollment in the School for a trial period of one (1) calendar month. If, at any time during the first month, the School Director determines that your child is unable to adjust to the School’s program, despite attempts to work with you and your child, either you or the School may terminate your child’s enrollment immediately. No refund will be given for fees and tuition paid for that month, even if your child is withdrawn within the first few days of attending.

Withdrawal

This Agreement is on a month-to-month basis. After the adjustment period, you will continue to have the right to withdraw your child from the program. However, you must give the School Director a 30-day written notice of withdrawal to avoid being charged for the next month’s tuition. If you do not give the required written notice, you will still be required to pay the next month’s tuition. For example, if you want your child’s last day to be June 30, you should give Notice of this intent by giving Notice before the preceding May 30 to avoid being charged for the month of July. If your child’s last day is in the middle of the month, you will still be charged for that whole month. This policy is to maintain consistency in our school.

Email to the Director, confirmed by a reply email, is considered written notice.

Termination by School

The School may terminate your child’s enrollment in the School effective immediately, if in the sole discretion of the School, it is in the best interest of the child or the School. Circumstances for immediate termination of enrollment include, but are not limited to:

  1. In the judgment of the School Director, the child’s behavior threatens the physical or mental health of other people in the School (including, but not limited to, biting or other physical contact done in ways that breaks the skin or leaves marks; bullying behavior; behavior that disturbs other children, etc.)
  2. You or your child bring a weapon into the School;
  3. Tuition and fees are not paid within 30 calendar days after payment is due;
  4. The child is picked up late (after the time the school closes) more than 3 days in any 30-day period; or
  5. You violate school policies as outlined in the Parent Handbook,

Photographs

We photograph children as part of our program to document the program for accreditation purposes, to share with families, and to market the school. These photographs may be included in print and online marketing,and may be posted to social media. Unless you indicate otherwise, you hereby grant permission for your child to be photographed for such purposes, and to assign all rights in such photographs to the School.

Stipulated Liability Waiver/Limitation

ACTING ON BEHALF OF YOURSELF AND YOUR CHILD, YOU HEREBY WAIVE AND AGREE TO RELEASE ANY CLAIMS WHICH YOU, YOUR CHILD, OR YOUR CHILD’S HEIRS AND SUCCESSORS MAY HAVE AGAINST THE SCHOOL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS FOR ANY AND ALL INJURIES, LOSSES OR DAMAGES TO YOUR CHILD, YOU CHILD’S PERSONAL PROPERTY AND YOUR PERSONAL PROPERTY WHICH MAY EXCEED THE LIMITS OF THE SCHOOL’S INSURANCE COVERAGE. BY SIGNING THIS ENROLLMENT AGREEMENT, YOU SPECIFICALLY LIMIT THE SCHOOL’S LIABILITY TO THE AMOUNT COVERED BY THE SCHOOL’S INSURANCE POLICIES.

Fees

A $500 non-refundable reservation/security deposit is required to reserve a space for each child. This will be used to reserve a space and to pay the last two weeks of the child’s stay at the school if your child stays for at least two months.

Tuition is due by the first day of each month for that coming month and is as follows:

Tuition charges are based on a child’s age, rather than which class he or she may be in. We promote children when we feel they are developmentally ready, but the cost is based on the child’s age, as younger children require more attention. Tuition does not include meals, snacks, or milk. Families are responsible for providing lunches, and snacks on a daily basis for their own children. Milk is provided by the school and served each day, If you do not want milk served to your child, you must notify the Director or Assistant Director in writing.

Late Payment: Payment is due by the first of each month. There is a $50.00 per week late fee incurred if payment is not made from the 2nd of the month until paid.

Late Pick-Up Penalties for arriving after we close at 6:30 PM

If your child is picked up after 6:30 PM Eastern Time, you will owe a fee of $1.00 for each minute after 6:30 PM. This late pick-up fee will be invoiced the following day and is due immediately. If your child is picked up late more than 3 times in one calendar month, the School will notify you of that fact, and your child's enrollment may be terminated immediately.

Late Pick-Up: There is a $1.00 per minute charge for each minute past the agreed upon pick-up time (12 noon or 6:30 PM).

PART-TIME *We offer part-time pricing on an individual basis

We offer early drop-off as early as 6:30 am, if arrangements are made at least 24 hours ahead of time.

A 5% sibling discount shall apply for one sibling only. The 5% discount is off the lower of the two tuition rates.(Only one discount is applied at any given point of time, so if you are on any other discount, a sibling discount will not be applied)

Persons using vouchers will be responsible for paying the amount of tuition that is not covered by the vouchers, and will also be responsible for full payment of tuition if/when the voucher expires or does not go through as expected.

Certification that All Information you gave or will give is Correct.

By signing this agreement, you certify that all information you have provided to the school is correct and you agree to provide any additional documentation if there are any changes in the information you have supplied or will supply to the school.
